What is the difference between Cerebral and Erb’s Palsy?

Erbs Palsy is a condition caused by excessive pressure being placed on the baby’s shoulder or neck during childbirth. As a result, the child’s branchial plexus become strained and while they can be repaired or reattached with surgery, injuries of this nature can occasionally cause permanent disability.

Cerebral palsy is a form of brain damage affecting muscle tone, movement, and motor skills. Cerebral Palsy can occur before or during a baby’s birth, or during the first 3 to 5 years of a child’s life.

What gives rise to a claim?

In order to claim we must be able to establish whether the child’s injuries resulted from medical negligence on the part of the medical practitioners, such as:

  • Failing to monitor the mother and/or child properly.
  • Failing to notice an irregular heartbeat before during or after birth.
  • Failing to deliver at the appropriate time, either naturally, or if necessary by Caesarian Section.

If we are successful here, we must then be able to demonstrate that injuries suffered were as a result of a deprivation of oxygen or oxygenated blood in the birth canal or while still in the womb.  To do this, we will look for signs of baby distress, missed during childbirth.
